Ombudsman Orders Remullas and 4 Others to Respond to Duterte Arrest Complaint

In a shocking development, the Office of the Ombudsman has ordered five high-ranking government officials to respond to a complaint filed by Senator Imee Marcos' Committee on Foreign Relations regarding the legality of former President Rodrigo Duterte's arrest and transfer to the International Criminal Court.

The officials, including Justice Secretary Jesus Crispin Remulla, Interior Secretary Jonvic Remulla, PNP chief Gen. Rommel Marbil, PNP-CIDG chief Nicolas Torre III, and Special Envoy for Transnational Crimes Markus Lacanilao, have been given 10 days to file a counter-affidavit.


According to Marcos, her panel's investigation uncovered acts by these officials that "very likely constitute criminal and administrative offenses." The complaint alleges that the officials played a role in Duterte's arrest and transfer to The Hague, which may have violated Philippine laws and international protocols.

Allegations Against the Officials

  • Justice Secretary Remulla: usurpation of judicial functions, grave misconduct, and conduct prejudicial to the best interest of the service

  • Interior Secretary Remulla: violation of the Anti-Graft and Corrupt Practices Act, arbitrary detention, grave misconduct, and conduct prejudicial to the best interest of the service

  • PNP chief Marbil: arbitrary detention, grave misconduct, and conduct prejudicial to the best interest of the service

  • PNP-CIDG chief Torre: arbitrary detention, grave threats, grave misconduct, and conduct prejudicial to the best interest of the service

  • Special Envoy Lacanilao: usurpation of official functions, false testimony, perjury, grave misconduct, and conduct prejudicial to the best interest of the service

The Road Ahead

The respondents' failure to file a counter-affidavit within the given period will be deemed as a waiver of their right to submit controverting evidence, and the preliminary investigation will proceed accordingly.

As the case unfolds, it remains to be seen whether the officials will be held accountable for their alleged roles in Duterte's arrest and transfer. One thing is certain, however: the outcome will have far-reaching implications for the country's justice system and its relationship with international authorities.
